Terms of Service
Coleman & Marks LLC · Effective May 2026
1. Service Scope
Cut & Mow (operated by Coleman & Marks LLC) provides lawn care services in Wisconsin including weekly, biweekly, and one-time mowing; bush and flower trimming; hand weeding; mulch installation; and seasonal cleanup. Services not explicitly described in your quote or invoice are not included.
2. First-Visit Pricing
Instant quotes generated on cutnmow.com are valid for your first visit only. Ongoing rates will be confirmed by Travis after the first service, based on actual property conditions. Pricing assumes the lawn and beds are in normal condition. Severely overgrown lawns may carry an additional setup fee, which we will quote and obtain approval for before any work begins.
3. Property Photography
By engaging Cut & Mow, you agree that we may take photographs of your property's lawn, beds, and landscaping for the following purposes:
- Pre-existing damage documentation. On the first visit we photograph the property to document existing conditions (broken sprinkler heads, fence damage, dead patches, etc.) for liability protection. These photos are stored privately and only used if a damage claim arises.
- Before-and-after portfolio. We may use anonymized before/after photos of completed work on our website, social media, and marketing materials. We never publish images that include identifying information (license plates, house numbers in close-up, people).
You may opt out of portfolio use at any time by emailing support@cutnmow.com. Pre-existing damage documentation is required and cannot be opted out of, as it protects both parties.
4. Insurance
Coleman & Marks LLC carries general liability insurance. A certificate of insurance is available on request. We are not responsible for damage arising from pre-existing property conditions documented on the first visit.
5. Pesticide & Spray Application
All pesticide and herbicide applications are performed under the supervision of a Wisconsin-licensed pesticide applicator. Material Safety Data Sheets (MSDS) and application notes are available on request after each treatment.
6. Weather, Cancellation & Rescheduling
We cancel or postpone service for heavy rain, thunderstorms, accumulating snow, lightning, or unsafe wind. Cancelled visits are rescheduled to the next available service day at no additional charge.
7. Payment Terms
First-visit services are invoiced on completion. Recurring clients are billed within 24 hours of service. Payment is due net 30 days from invoice date. Some services may require deposits.
8. Right to Refuse or Discontinue Service
We may decline or discontinue service for any property where conditions present a safety risk to crew or equipment (unsafe access, aggressive animals, hidden hazards, etc.). We will notify you and refund any prepaid balance.
9. Limitation of Liability
Our liability for any claim arising from services is limited to the amount paid for the specific service in question. Neither party is liable for indirect, incidental, or consequential damages. This limitation does not apply to gross negligence or willful misconduct.
SMS Communications
By providing your phone number and checking the SMS consent box on our quote, contact, or HOA & Commercial bid form, you authorize Cut & Mow to send you transactional text messages related to your quote, scheduled service, and billing. You confirm that you are the owner or authorized user of the phone number provided.
- Message frequency: 1–5 messages per active service.
- Message and data rates may apply per your carrier.
- Reply STOP at any time to unsubscribe. Reply HELP for help.
- Carriers are not liable for delayed or undelivered messages.
- You may revoke consent at any time without affecting your other services with us.
10. Changes to These Terms
We may update these terms with reasonable notice posted on cutnmow.com. Continued use of our services after a change constitutes acceptance.
